1. Acceptance of Terms

By creating an account or using DarijaCC ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by DarijaCC, based in the Kingdom of Morocco.

2. Description of Service

DarijaCC is an AI-powered transcription tool that converts spoken Moroccan Arabic (Darija) from video and audio files into time-synchronized subtitles. The Service uses third-party AI providers to process your content, including speech-to-text recognition and dialect correction.

3. Eligibility

You must be at least 18 years old (or the age of legal majority in your country) to use the Service. By using DarijaCC, you confirm you meet this requirement.

4. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information during registration.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Free Trial Minutes

New accounts receive 5 free transcription minutes upon registration so you can fully evaluate the Service before making any purchase. Free trial minutes do not roll over and are not redeemable for cash.

6. Subscriptions and Credits

6.1 Subscription Plans

DarijaCC offers monthly subscription plans that include a set number of transcription minutes per billing period. Minutes from a subscription plan expire at the end of each billing period and do not roll over to the next month.

6.2 Top-Up Credits

You may purchase additional transcription minutes ("top-up credits") as one-time purchases. Top-up credits do not expire and are consumed after your subscription minutes are exhausted.

6.3 Billing

Subscription payments are billed in advance on a monthly or annual basis. Payment is processed through Lemon Squeezy, our authorized payment provider. By subscribing, you authorize recurring charges to your payment method.

7. Acceptable Use

You agree not to:

• Upload content that is illegal, defamatory, threatening, or violates any third party's rights
• Use the Service to process content you do not have rights to
• Attempt to reverse-engineer, scrape, or abuse the Service's infrastructure
• Use automated tools to circumvent usage limits
• Resell or sublicense access to the Service without written permission

8. Intellectual Property

8.1 Your Content

You retain full ownership of the files you upload and the transcriptions generated from them. By uploading content, you grant us a limited, non-exclusive license to process it solely for the purpose of providing the Service.

8.2 Our Service

DarijaCC, its design, codebase, and brand are our intellectual property. You may not copy, modify, or distribute any part of the Service without our written consent.

9. AI Processing and Third-Party Providers

DarijaCC uses third-party AI services for speech recognition and Darija dialect processing. By using the Service, you acknowledge that your audio content will be transmitted to these services solely to generate your transcription. Full details of our data processors are listed in our Privacy Policy. We do not sell your content to third parties.

10. Data Storage and Retention

Uploaded files and generated transcription data are stored in our secure cloud storage. We retain your data as long as your account is active. You may delete your content or account at any time. Upon account deletion, your data is removed within 30 days.

11. Disclaimers

• The Service is provided "as is" without warranties of any kind.
• AI transcription is not perfect. We do not guarantee 100% accuracy, particularly for dialects, background noise, or low-quality audio.
• We are not liable for any errors, omissions, or delays in transcription output.

12. Limitation of Liability

To the maximum extent permitted by applicable law, DarijaCC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the three (3) months preceding the claim.

13. Termination

We reserve the right to suspend or terminate your access at any time, with or without cause. You may cancel your account at any time via account settings or by contacting us. Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We may update these Terms at any time. If changes are material, we will notify you by email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the Kingdom of Morocco. Any disputes shall be resolved in the competent courts of Morocco.
